Terms & Conditions – MAXOM Marketplace
OVERVIEW
Welcome to MAXOM.
Throughout these Terms, “we”, “us” and “our” refer to MAXOM as the marketplace platform.
MAXOM operates a curated online marketplace where independent brands offer their products. MAXOM provides the technical infrastructure, content, features, and services (the “Services”) to enable customers to browse, purchase, and interact with brands.
MAXOM is technically powered by Shopify, which supports the operation of the Services.
These Terms & Conditions (“Terms”) govern your access to and use of the Services.
Please read them carefully, as they contain important legal information, including limitations of liability.
By accessing, browsing, or purchasing through MAXOM, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the Services.
1. ACCESS & USER ACCOUNTS
By using the Services, you confirm that you are at least the age of majority in your place of residence or have permission from a legal guardian.
To use certain features (such as placing orders), you may be required to provide personal information including email address, billing, payment, and shipping details. You represent that all information provided is accurate, current, and complete.
You are solely responsible for:

2. PRODUCTS ON THE MARKETPLACE
MAXOM does not sell products directly.
All products are offered and sold by independent brands listed on the marketplace.
Product images and descriptions are provided for informational purposes only. Colors and appearance may vary depending on device and display settings.
MAXOM does not guarantee that products will meet your expectations or exactly match their online representation.
Brands may update product descriptions, availability, or pricing at any time and may discontinue products without notice.
3. ORDERS
By placing an order, you submit a binding offer to purchase a product.
The purchase contract is concluded directly between you and the respective brand, not with MAXOM.
MAXOM reserves the right to decline or cancel orders on behalf of brands, for example in cases of payment issues or suspected misuse.
Returns, refunds, and withdrawals are governed by the applicable Return & Refund Policy of the marketplace.
Orders are intended for personal, non-commercial use only. Resale is prohibited.
4. PRICES & PAYMENTS
Prices are shown in the currency displayed at checkout.
Unless explicitly stated otherwise, prices may not include taxes, shipping fees, customs duties, or import charges.
You agree to provide valid payment information and confirm that you are authorized to use the selected payment method.
5. SHIPPING & DELIVERY
Shipping and delivery are handled by the respective brand.
All delivery times are estimates only and not guaranteed.
MAXOM is not responsible for delays caused by carriers, customs authorities, or events beyond reasonable control.
Risk of loss transfers to the customer once the order is handed over to the shipping carrier.
6. INTELLECTUAL PROPERTY
All content available on MAXOM, including but not limited to text, graphics, logos, designs, and layout, is the intellectual property of MAXOM or the respective brands and is protected by applicable laws.
Content may only be used for personal, non-commercial purposes.
Any reproduction, distribution, or use without prior written consent is prohibited.
7. THIRD-PARTY TOOLS
MAXOM may provide access to third-party tools or integrations.
These tools are provided “as is” and “as available”. MAXOM assumes no responsibility or liability for their use.
8. THIRD-PARTY LINKS
The Services may contain links to third-party websites.
MAXOM is not responsible for the content, accuracy, or practices of third-party sites. Access is at your own risk.
9. RELATIONSHIP WITH SHOPIFY
MAXOM uses Shopify as a technical service provider.
Shopify is not a party to any purchase contract and bears no responsibility for transactions conducted on MAXOM.
10. PRIVACY
Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including GDPR.
11. FEEDBACK & REVIEWS
By submitting feedback, reviews, or other content, you grant MAXOM a worldwide, royalty-free, perpetual license to use such content for operational and promotional purposes.
There is no obligation to compensate for submitted feedback.
12. ERRORS & UPDATES
MAXOM reserves the right to correct errors, inaccuracies, or omissions and to update content at any time without prior notice.
13. PROHIBITED USES
You may not use the Services for unlawful, harmful, or abusive purposes.
Violations may result in suspension or termination of access.
14. TERMINATION
MAXOM may terminate or restrict access to the Services at any time, particularly in cases of violation of these Terms.

MAXOM makes no warranties regarding uninterrupted or error-free operation.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, MAXOM shall not be liable for indirect, incidental, or consequential damages arising from the use of the Services.
17. INDEMNIFICATION
You agree to indemnify and hold harmless MAXOM from claims arising out of your use of the Services or violation of these Terms.
18. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain valid.
19. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and MAXOM regarding the use of the Services.
20. ASSIGNMENT
You may not assign your rights or obligations under these Terms without prior written consent.
21. GOVERNING LAW
These Terms are governed by the laws of the Federal Republic of Germany.
22. CHANGES TO THE TERMS
MAXOM reserves the right to update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
